I wrote in a previous post about the banning of the sale of edible CBD products in the state of Maine. It seemed like it was a pretty cut and dry issue, but apparently, it has been anything but.
Today I came across this article from pressherald.com (where I originally found the news about the shutdown of edible products) about a lot of confusion that is going on regarding the legality of cannabidiol products.
The article talks about the case of one shop owner who was given the green light to open up their newly renovated kitchen, but given the bad news that federal law would not allow them to sell products that contained CBD in edible form. I am a bit confused by what is being said in this article, as I believe that this is true, as the FDA has not yet approved the use of CBD as a food additive. However, the article is saying that the state had to apologize for inspectors who acted without authority or enough information on state and federal laws.
The state declared again that foods made or infused with CBD are against the law, so I don’t see exactly what was said by the inspector that was untrue. In any case, apparently, the inspector that told some stores to take their products off the shelves (perhaps they had tried to get them to take all CBD products off the shelf) caused a bit of a panic by other shop owners. Or, reading further in the article, it seems maybe that they made the comment that edibles could only be sold by licensed sellers. Or some officials are enforcing it, and others are not?
This is causing a bit of an uproar in what was supposed to be a booming industry in this state. Many people specifically moved their operations to Maine in recent years due to what was foreseen as a very favorable jurisdiction to run this type of business. It was thought that Maine would be a welcoming area for hemp and the economic prosperity that it could provide. Further optimism was created with the passage of the Hemp Act last year.
However, state law is becoming a big threat to this industry’s survival. They are, however, trying to fix this through new legislation. There are talks about creating a bill similar to one that they already have regarding raw milk. Maine is the only state that currently is able to sell raw milk, and some legislators are proposing writing a bill similarly for hemp that would let them diverge from FDA rules and be allowed to sell cannabidiol in edible form.
In any case, I know that CBD exists in a gray area, but all of this confusion created by the state health department itself is not helping matters at all. I hope that they come to a resolution regarding its legality soon. If you are a resident of Maine and are worried that you may no longer be able to buy cannabidiol products at a local store, you can always shop at these CBD vendors online instead!
There has been a lot of news lately about different municipalities shutting down the sale of CBD in their jurisdiction. I go through some of the cases in another post here.
For the most part, the crackdowns have to deal with the sale of CBD edibles. The reason behind this is because while cannabidiol has been approved on the federal level, thanks to the Farm Bill of 2018, it is still under research by the FDA. For this reason, it is not yet approved as a food additive, so some areas are enforcing that and banning the sale of edibles.
CBD is pretty much in a gray area at the moment, and nowhere is that more evident than with what is going on currently in North Carolina.
To say that there is a gray area in North Carolina is an understatement. Previously there had been news that the state is really cracking down on the sale of cannabidiol in their state. It was reported that the authorities were going to begin sending letters of warning to shops about what they can and cannot sell.
However, when talking to shop owners in N.C., none of them have been able to say that they have received any such notification. Given no warnings from the state, they continue to operate business as usual.
So what is happening here? According to this article from Fox46Charlotte.com, the letters have been sent out – it’s just that they are not going out to the shop owners. Instead, the warning letters being sent to the distributors and suppliers. According to one shop owner, who said they have not themselves received a letter, the only letters that they are aware have been sent to their processors.
I think it is a bit of a crappy situation for shop owners in North Carolina at the moment. This uncertainty makes it a very uneasy time to be a proprietor of a business that relies on CBD as a significant portion of their revenue. They can continue to sell their products at the moment, but there is an uneasiness about a pending crackdown on the shops themselves. They will have to plan for that and have contingencies should that happen.
On top of that, I’m a bit disappointed in the state putting them in this situation. It doesn’t sound like this is just an edibles issue like we’re seeing in other states. Rather, it seems to be against most (if not all) cannabidiol products. It seems like the state is not understanding the health and wellness benefits of this alternative medicine, which is a shame. CBD has helped my life tremendously, and I know I am not alone in that thinking. I hope the state keeps their hands off this market and lets the shop owners have free reign to sell these products that benefit their customers.

It seems like all that time that Martha Stewart has been spending with Snoop Dogg has begun to rub off on her. Of course, we all know Snoop D-Oh-Double-G as one of the world’s preeminent pot smokers, and it looks like that influence has carried over to the business interests of his co-host as she has announced that she is getting into the CBD industry.
On Thursday, Stewart made the announcement that she is partnering with a company called Canopy Growth to develop a line of cannabidiol products. Products in the catalog will be for both human and pet use.
Before you think that she is digging deep into this, it is expected that she will more be playing an advisory role. Of course, considering all of the different business interests she has, this is to be expected. It’s better to leave all of the logistics of cultivation, extraction, and distribution of these products to a trusted team. She will be partnering Sequential Brands Group, a company that she has worked with for many years, to oversee this new brand. With the attachment of her name and the opportunity in the booming CBD industry, the stock price of Sequential surged after the announcement.
As said by Stewart in a statement released to the press, “I am delighted to establish this partnership with Canopy Growth and share with them the knowledge I have gained after years of experience in the subject of living.
I’m especially looking forward to our first collaboration together, which will offer sensible products for people’s beloved pets.”
The marijuana company that she is partnering with for the crops for this operation, Canopy (based in Ontario, Canada), is currently the largest producer of pot in the world. They have stated plans to invest between $100 and $150 million in an industrial hemp park in New York to support this new venture. Certainly, aligning with a brand with cache like Martha Stewart carries, I can only imagine this will be a fruitful relationship for all.
This isn’t Canopy’s only foray into partnerships with big-name brands, as they have also recently announced a partnership with Constellation Brands (makers of Corona) to develop a beer infused with CBD.
